MCR avoids legal action from Maine University

I don't think they had a right to sue. Or take ANY legal actions against MCR for that matter. They had no control over the situation. It's not like Bob planned on becoming injured. They hate to cancel shows. And-----How did the University lose money? Like Deb said, the guys bring all their own stuff, ect. I can understand the Uni being upset, but I think they took it to an extreme. |

I doubt MCR brings everything, and since they're such a big band they need big accomodations. I know that bringing in a stage costs a lot because my friend is in UCSD and they have the Sun God Festival (which had MCR play in 2006). Setting up a concert, even a school one, costs A LOT. OVerall, the price was fair. They were angry because MCR didn't find a replacement in time for their concert but played the next day. I guess they just felt cheated out of it. I'm glad they settled this out of court or MCR'll would have an actual lawsuit to take care of and lose more money. On the other hand, sorry for the kids who missed it, but I hope MCR doesn't agree to play at UMaine again. The school was too fired up about it...now they cooled down and got their money and is thinking asking. |

Granted I don't have all the facts but legally that should have nullified the contract and meant they didn't have to pay anything as the frustrating event was beyond their control. Hmm. If this suit happened years a go when they did, then, yes I would say you are right. But the fact is, no matter how much oh-so-loyally-hardcore MCR fans hate it, they ARE a big band now! They are mainstream. They've played arenas across the globe. And what did you think I meant by big accommodations? Like diva demands? No. I mean they're not some little band like they were three years ago; their set has become more elaborate and expensive. MCR is a very dramatic band--they like their lights and their effects. UMaine had tcontracts with the sound, stage and promotion already paid for MCR to play, which means they lost a lot of money because MCR cancelled. Even if MCR offered to do a makeup, the money is still gone. That's what they're suing for, so it's not something stupid and out of the blue. The face is they DID lose money. So, if MCR paid, 20K is a pretty fair price. And uh, I never said it was fair for MCR to pay, I said the price was fair. If they wanted like 50k+, I wouldn't be saying a single good thing about UMaine. Like I said in my first post, I believe both side had their mistakes, whether it was intentional or not. I do believe, however, as I've read more about case and the possible contract MCR signed, that the "legal action" thing shouldn't have happened because MCR pulling out was under the "Act of God" clause, which would ultimately excuse them (no matter how much UMaine lost). MCR could've easily countered UMaine with their lawyers but decided not to and just paid up 'cause they didn't want a headache. Why? Because 20K is nothing for this band who probably get more than twice that amount for every show they play. And why do they get paid a lot? Well, as a loyal MCR fan, I'm sure you know it's because they're such a big, expensive band (though not as expensive as some, but the price is still pretty hefty) that doesn't play in basements anymore. Correct me if I am wrong about anything. |
