Court News:
HACKENSACK, N.J. (CN) - The original drummer for the rock group My Chemical Romance says the band cheated him of royalties from its first album and won't show him the books. Matthew Pelissier sued his former bandmates and Eyeball Records, which distributed the album "I Brought You My Bullets, You Brought Me Your Love."
Pelissier said he has not been paid for his work on the album since October 2004, one month after leaving the band. According to Nielsen SoundScan, more than 285,000 copies of the album had been sold as of January.
Pellissier says that when he left the band he was granted "an undivided twenty percent income interest in the group masters."
He claims that a clause in the agreement stating that he "shall have no direct audit or inspection rights against Eyeball or any third party," is "not valid or enforceable."
He also sued current band members Gerald Way, Raymond Toro, Frank Iero and Michael Way, and the band itself.
Pellissier says Eyeball owes the band additional royalties from digital sales of songs and music videos sold through iTunes that were not part of the original agreement. He is represented by Nicholas Schillaci of Paterson, N.J.

Interesting, and to be compeletly honest i dont understand what the lawsuit paper thing says.
Part of me thinks that I should be on Matts side, but i think its just cause i dont understand the article/read it wrong.

^ I think you read it right. I mean, obviously there are two sides to the story but from what it says there, Matt's in a fair enough position.
However, I find it interesting that he alledgedly doesn't want anything from Three Cheers, as he also played on that album, right?

I don't think it will go over well in court, the papers say it was only a verbal agreement and in court you usually need a little more than that to back up your claims...like a written agreement....so I doubt anything will actually happen with it, even if it's fair that he get the money, he should have gotten more concrete evidence, because in the end both of them could have been lying and without evidence to tell which one was verbal statements are pretty much useless.

Surely he'd want something from Revenge aswell though? and why did it take him so long to get on to it if he hasn't been paid since 2004 thats almost 5 years.?

He did play on 3CFWR.
I thought of that too. WTF? why wouldnt he want things from that? But then again. Revenge was on Reprise, and thats a whole 'nother lawsuit

But, if after 5 years he still hasn't been paid money that he was contractually entitled to, then he has every right to go and try to get what he is owed. If someone owed you several thousands of dollars, you wouldn't just give it up after 5 years, you would do what you had to do to get that money because it's yours and you worked for it and are entitled to it.

That is the point of a contract: to ensure that each person's rights are protected and that none of them are taken advantage of by the others. If Matt has a case, then he has every right to pursue it and get what he is due. It doesn't speak poorly of MCR; well, unless they know that they owe him the money and refuse to pay up. TBH I doubt any of the guys are even dealing with this suit, the labels have lawyers that are hired to do these kinds of things for them.

Par for the course: the anti-MCR contingent in this fandom has already started taking Otter's side without knowing all the facts. And while I don't want to attack anyone, why would you feel compelled to take sides when you don't understand what you are reading? There are always two sides to every story and then the truth.

Well, honestly?
Reading through the legal document it does seem fair that Otter gets his piece.
That money'd probably do him great.
I mean like, send his kids to college or whatever.
Why shouldn't he want that?
This isn't just an Eyeball deal though, he is personally suing MCR as well. He's not just going for the record company.
