If you get pulled over for say drunk driving or speeding the officer has a right ONCE your already pulled over to ask if your here legally or not. In my opinion, that's how it should be all over. |

However, to me there seems to be nothing in the law which could keep officers from abusing this power. And up to which point in the legalization process does an immigrant have to be to avoid deportation? After all, the process takes several years and, from what I understand, can't be made final until after 8 years. |

I don't agree with the abuse of power in any case. It would be unfortunate if that were to happen, but I personally don't think most police officers would do that just because. Some, yes. But I don't think they are in the majority, in my opinion. There is nothing in the law to stop them because that is something that can't really be governed. They can be told to not abuse their power. They can be told the consequences of them abusing their power. But at the end of the day if someone wants to abuse their power, they will. I'd like to believe most who do that would get caught out, but who knows. |

You can live in the US as a non-citizen who is not attempting naturalization. That said, I have to say that if you come to a country with the intent of becoming a citizen (or not, if you live here and are not a citizen for whatever reason), you should not expect to be allowed to remain in-country and also break laws. I know of a German citizen who was just deported to Germany after evading taxes. I know of other foreign residents who have been deported for breaking laws. I am not sure if they were all federal laws or not, but I don't see a problem with deporting a non-citizen for breaking laws. Abuses of the law aside, I see no issue with that viewpoint alone. |

I honestly believe that if someone breaks a law we should be allowed to deport them if they are here illegally. Yet that doesn't happen a good portion of the time. If your in the process of becoming a citizen you can't be deported if they happen to stumble across the fact your here and your not a citizen since you are going through the process. I know people who came here on work visas and while they were here changed that status to resident. Honestly if a police cop in Arizona has a suspicion that there's a car and the people inside are illegal, they could make up a reason to pull over that car. Now sure, the police could find someway to justify as to why they pulled the car over besides just that suspicion. But it is an officers job to uphold the law, and people being here illegally is against the law. Now I fully admit I'm biased, I get treated like shit on a daily basis by the people in my area, people this law is "targetting". I fully support the law and wish California took the law up as well. |
